Terms of Service

These are the terms for using Banded. Using it means you accept them. We've kept them short and in plain English on purpose.

You must be 21

Banded is a journal for cigar smokers and is for adults 21 and over. By using it you confirm you're 21 or older. We don't sell cigars, and nothing here is an encouragement to smoke.

Banded is in beta

We're building this in the open, and it shows: things break, features move, and the occasional rough edge is the price of admission. We keep backups and we take your log seriously, but the service is provided as is, without warranty of any kind.

Your account

• Sign in with an email you control. You're responsible for what happens under your account.
• One account per person.
• You can delete your account at any time from the Account page. It erases everything, immediately and permanently.

Your cigars are yours

Your photos, ratings and notes belong to you. You give us only the permission we need to run the service: to store your content, show it back to you, and — for cigars you've left in the Rank & File, or chosen to share — show that content to others. Switch a cigar out of the Rank & File and that permission ends for it.

You keep the right to your own photos. We don't claim ownership and we won't license them to anyone else.

Fair use of the app

Don't:

• Upload anything illegal, or anyone else's photo without their say-so.
• Upload people. Band shots are of cigars — photos of identifiable people don't belong in a public board.
• Scrape, hammer, or resell the service, or try to slip past your plan's allowance.
• Use Banded to promote tobacco sales to anyone under 21.

We can suspend an account that abuses the service. If we do it to yours, we'll tell you why.

Free and paid

• Free covers the humidor: log cigars, filter by wrapper shade, rate, share, and a monthly allowance of AI band scans. When the allowance runs out, you name cigars yourself — you never lose your log.
• Paid lifts the scan allowance and adds plain-English search. Billing is monthly through Stripe, cancel any time, and cancelling leaves you on Free with everything you've logged intact.
• Prices can change. If yours does, we'll tell you first.

Aggregate insights

We may publish or sell aggregate, de-identified statistics about cigars. We never sell your identity, your photos, or your location. The Privacy Policy spells out exactly where that line sits.

Ending it

You can stop using Banded whenever you like. We may end or change the service — if we shut it down, we'll give you notice and a way to get your data out first.

The legal bit

To the fullest extent the law allows, DevCSM, LLC isn't liable for indirect or consequential damages, and our total liability is limited to what you've paid us in the last twelve months. These terms are governed by the laws of the State of Tennessee, and disputes belong to the state or federal courts sitting there.

Changes

If we change these terms materially, we'll say so in the app before it takes effect.
